PRIVACY POLICY

AGROJUSTO S.A.S., domiciled at Belgrano 34, Mendoza, Argentina (“Agrojusto” or “we”), takes your privacy seriously and ensures the security and protection of the personal data (“Personal Data”) of all customers, partners, suppliers, and users (“Users” or “You”) of the website “agrojusto.com” and of any other website, platform, or application operated by Agrojusto (“Platform”).

This Privacy Policy (“Privacy Policy”) is intended to inform you how we use and disclose the information collected from your visits to our Platform and from the messages we exchange with You (“Communications”).

This Privacy Policy applies only to information collected through the Platform and provides an overview of our privacy practices and the choices you can make, as well as the rights you can exercise in relation to the Personal Data we process. This Privacy Policy does not apply to third-party applications, products, services, websites, or social media features that may be offered or accessed through the Platform. Accessing these links will cause you to leave the Platform and may result in the collection or sharing of information about You by third parties. We do not control, endorse, or make any representations about these third-party sites or their privacy practices, which may differ from ours. We recommend that you review the privacy policy of any website you interact with before allowing the collection and use of your personal data.

If You send or share with us Personal Data about other people, You represent and warrant that You have obtained the consent necessary to authorize the use of such information under the terms of this Privacy Policy, as required by the Personal Data Protection Laws.

  1. Definitions

1.1 For the purposes of this Privacy Policy:

(i) “Personal Data” means any information that directly or indirectly identifies or can identify a natural or legal person, such as name, date of birth, or IP address, among others;

(ii) “Sensitive Personal Data” means any information that reveals racial or ethnic origin, religious beliefs, political opinions, membership in a trade union or in an organization of a religious, philosophical, or political nature, data concerning health or sex life, or genetic or biometric data relating to the data subject;

(iii) “Processing of Personal Data” means any operation performed on Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction. Any other operation provided for under the applicable legislation is also considered Processing of Personal Data;

(iv) “Data Protection Laws” means all legal provisions governing the Processing of Personal Data, including, but not limited to, Personal Data Protection Law No. 25.326, its Regulatory Decree No. 1558/2001, and the provisions and resolutions issued from time to time by the enforcement authority.

  1. Personal Data collected

2.1 The general public may browse the Platform without registering or providing their Personal Data, except for the data collected automatically, as detailed below in section 2.3 (iii).

However, some features of the Platform may depend on registration and the submission of Personal Data.

2.2 If You contact Agrojusto, Agrojusto may collect:

(i) Contact data. Name, nickname, phone number, city, state, and email address;

(ii) Information you submit. Information you send us through the available form (for example, complaints, suggestions, criticism, compliments, etc.).

2.3 During general browsing of the Platform, Agrojusto may collect:

(i) Preferences. Information about your preferences and interests regarding the Platform (when you tell us what they are or when we can infer them from your behavior on the Platform) and how you prefer to receive our Communications;

(ii) Platform browsing data. Information about your visits to and activities on the Platform, including the content (and any advertising) you view and interact with, information about the browser and device you are using, your IP address, your location, or the address of the website from which you access the Platform. Some of this information is collected using our automatic data collection tools, which include cookies, web beacons, and embedded web links. (ii) Pseudonymized or aggregated data. During our operations, in certain cases, we apply a de-identification or pseudonymization process to your Personal Data so that it is reasonably unlikely that you could be identified through the use of that data with the available technology; and

(iv) Other information we may collect. Other information that does not specifically reveal your identity or is not directly related to an individual, such as browser and device information; platform usage data; and information collected through cookies, pixel tags, and other technologies.

2.4 In specific situations (for example, surveys we conduct to learn about our customers' profiles), we may process Sensitive Data of our direct and/or indirect customers (as in the case of our customers' customers). When this occurs, such processing will be carried out in accordance with the requirements established in the Personal Data Protection Laws, in particular by obtaining the consent of our customers and/or consumers, when necessary.

2.5. You are not required to share with us the Personal Data we request; however, if you choose not to share it, in some cases we may be unable to give you full access to the Platform or to some specialized features, or we may be unable to respond effectively to any inquiry you may have. In cases where your consent is required to carry out a particular activity, we will inform you of the consequences of not providing it.

  1. Why we collect and use your Personal Data

3.1 We collect and use Personal Data to manage your relationship with Agrojusto and to provide you with better service when you use the Platform, personalizing and improving your experience. Examples of how we use Personal Data include:

  • To enable You to register for, access, use, and browse the Platform;
  • To verify and validate your identity;
  • To provide our services through the Platform, process your requests and transactions, and create, maintain, and follow up on a record of the operations you carry out on the Platform;
  • To respond to the requests and inquiries you make through the Platform, whether about Agrojusto's products and services and/or others;
  • To keep in contact with Users and address their comments, complaints, and suggestions;
  • To collect and invoice the amounts provided for in the services You have contracted;
  • To confirm or correct the information we hold about You;
  • To send you information we believe will be of interest to you, through marketing communications;
  • To personalize your experience using the Platform;
  • To contact You at a phone number and/or email address provided, for support and troubleshooting purposes and, when necessary, for reasonable business purposes, such as sending you promotional information about products or services from Agrojusto or our partners;
  • To improve the Platform's services and features;
  • To comply with the requirements of legal proceedings;
  • To comply with a decision of a court or competent administrative authority, including courts and authorities outside the Users' country of residence;
  • To enforce our Terms and Conditions of Use;
  • To protect our operations;
  • To protect the rights, privacy, and security of Agrojusto, You, or other Users or third parties;
  • To detect and prevent fraud;
  • To allow us to pursue available remedies or limit the damages we may sustain;
  • To conduct quality surveys to understand your relationship with us and the services we provide to you (for example, your business journey and the strategies applied in your online store in a given year);

3.2 If you visit our careers page and are interested in one of the open positions, we may also process your Personal Data as part of our recruitment and selection process.

  1. Third parties with whom we share your Personal Data

4.1 Agrojusto may share your Personal Data:

(i) With the partner company(ies) you select or choose to send your data, inquiries, questions, etc. to, as well as with Agrojusto's service providers or partners to manage or support certain aspects of our business operations on our behalf, including server providers for staging and production; data hosting and storage providers; providers of identity validation, fraud management, customer service, sales on our behalf, order fulfillment, content personalization, advertising and marketing activities (including digital and personalized advertising), and IT services; payment processing companies; computer systems providers; cloud service providers; technology service providers in general, call centers or customer service centers; advertising or marketing agencies; data analytics agencies; insurance, legal, and/or financial consultants; other agents and representatives, for example;

(ii) With third parties, to help us manage the Platform;

(iii) With third parties, where necessary, to assist in recruitment and selection processes; and

(iv) With financial institutions and any other company that may be necessary to provide the Services offered through the Platform.

Users’ Personal Data will not be used by third-party service providers for any purpose other than the one for which Agrojusto transferred it to them, and they will always process it in accordance with Agrojusto’s instructions.

(v) In the course of a due diligence process in the event of a potential reorganization, merger, sale, joint venture, assignment, or transfer of all or part of our business, assets, or capital, with the prospective acquirers and/or their advisors, always under an obligation of confidentiality.

(vi) With third parties acquiring through any reorganization, merger, sale, joint venture, assignment, transfer, or conveyance of all or part of our business, assets, or capital (including those related to insolvency or similar proceedings), who will then become responsible for processing the Personal Data.

(vii) With entities belonging to the same corporate group as, or companies affiliated with, Agrojusto worldwide, in accordance with this Privacy Policy.

  1. International transfers of Personal Data

5.1 When it is necessary to transfer Personal Data, Agrojusto will adopt the necessary safeguards so that your Personal Data enjoys a level of protection equivalent to the one we have adopted and, where necessary, we will use the international data transfer mechanism required by data protection laws.

5.2 You expressly understand and agree that your Personal Data may be shared, assigned, or transferred outside your country of residence to be processed for the purposes described in this Privacy Policy, even when the recipients are located in other countries that do not guarantee the same levels of protection as the Personal Data Protection Laws.

  1. Automatic collection of Personal Data

6.1 When you visit the Platform, it may store or retrieve information in your browser, mainly through the use of cookies, which are text files containing small amounts of information.

6.2 This information may be about You, your preferences, or your device, and is mainly used to make the Platform work as You expect. The information generally does not identify you directly, but it can provide a more personalized web experience.

6.3 In accordance with this Agrojusto Privacy Policy, we and our third-party service providers may collect your Personal Data in various ways, including, among others:

(i) Through your browser or device: most browsers and Internet-access devices collect certain information, such as computer type, screen resolution, operating system name and version, device model and manufacturer, language, and the type and version of the Internet browser you are using. We may use this information to ensure that the Platform works properly.

(ii) Use of cookies: Information about your use of the Platform may be collected by third parties through cookies. Cookies are pieces of information stored directly on the computer you are using. Cookies make it possible to collect information such as browser type, time spent on the Platform, pages visited, language preferences, and other anonymous traffic data. We and our service providers use this information to protect security, facilitate navigation, display information more efficiently, and personalize your experience when using the Platform, as well as for online tracking. We also collect statistical information about your use of the Platform in order to continuously improve our design and functionality, to understand how the Platform is used, and to help you resolve issues related to the Platform.

  1. Duration of processing

7.1 Personal Data processed by Agrojusto will be stored for as long as necessary to fulfill the purposes for which it was collected.

7.2 However, Personal Data may be retained for a longer period in order to comply with a legal or regulatory obligation, to comply with an order from a competent authority, or for Agrojusto to exercise its right of defense in judicial or administrative proceedings, for the entire applicable limitation period.

  1. User rights

8.1. You may, at any time, exercise the rights guaranteed to you as a data subject by the Personal Data Protection Laws; among others, You may request from Agrojusto:

(i) confirmation that your Personal Data is being processed;

(ii) access to your Personal Data;

(iii) correction of incomplete, inaccurate, or outdated data;

(iv) anonymization, blocking, or deletion (where applicable) of unnecessary or excessive data, or data processed in violation of the law;

(v) portability of your Personal Data to another service provider, provided this does not affect our industrial and trade secrets;

(vi) deletion of Personal Data processed with your consent, to the extent permitted by law;

(vii) information about the entities with which your Personal Data has been shared;

(viii) information about the possibility of not giving consent and the consequences of not giving it; and

(ix) withdrawal of consent.

8.2 Your requests will be handled with special care so that we can guarantee the effectiveness of your rights. As a result, we may ask you to provide proof of your identity to ensure that Personal Data is shared only with its owner.

8.3 Please note that, in certain cases (for example, due to legal requirements or technical limitations), your request may not be fulfilled immediately and/or Agrojusto may be unable to fulfill it due to the need to comply with legal obligations.

8.4. Please be advised that the data protection authority in your country of residence may have the power to handle complaints and claims filed by anyone whose rights have been affected by a breach of the applicable personal data protection regulations.

8.5. Users shall have the right to make responsible use of their account on the website. At any time, the User may exercise the rights set out in section 8.1 of this Privacy Policy using the form available at this link. For Users residing in Argentina, the owner of the Personal Data has the right to access such data free of charge at intervals of no less than six months, unless a legitimate interest in doing so is demonstrated, as established in Article 14, subsection 3 of Law No. 25.326 of the Argentine Republic. The enforcement authority (in Argentina, the National Directorate for Personal Data Protection, the Supervisory Body of Law No. 25.326) has the power to handle complaints and claims filed in connection with breaches of personal data protection regulations.

  1. Security of Personal Data

9.1 We strive to adopt within our organization the technical and organizational measures provided for by the Data Protection Laws that are appropriate for protecting Personal Data. Unfortunately, we cannot guarantee that any data transmission or storage system is 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you believe that the security of any of your accounts has been compromised), please notify us immediately.

  1. Hypertext links to other websites and social networks

10.1 The Platform may contain hypertext links that will redirect you to the websites of our partners’ networks, advertisers, suppliers, etc. If you click on a link to any of these sites, please remember that each site has its own privacy practices and that we are not responsible for those policies. Please review those policies before submitting any Personal Data to these sites.

10.2 We are not responsible for the collection, use, and disclosure policies and practices (including data protection practices) of other organizations, such as Facebook, Apple, Google, Microsoft, or any other software developer or app provider, social media platform, operating system operator, wireless Internet service provider, or device manufacturer, including any personal data you disclose to other organizations through or in connection with such apps, or that you post on our social media pages. We recommend that you review the privacy policy of every website you visit and of every service provider you use.

  1. Use of the Platform by minors

11.1 The Platform is not intended for persons under 18 (eighteen) years of age, and we ask that such persons not provide us with any personal data.

  1. Updates to this Privacy Policy

12.1 If we modify our Privacy Policy, we will publish the new text on the Platform with the updated revision date. We may change this Privacy Policy at any time. If there is a material change to the terms of this Privacy Policy, we may inform you using the contact information we hold in our database or through a notice on our Platform, and we will obtain your consent where required under the Personal Data Protection Law.

12.2 We undertake not to process your Personal Data for any purpose other than the one previously stated, unless otherwise required by law or court order.
